Occupational Licensing Information


    Anyone operating a business within the Town of Bay Harbor Islands is required to obtain a municipal occupational license in addition to any County or State licenses. Fees are determined by the type of business or profession, and must be renewed annually, prior to October 1st.

Who needs an Occupational License?

    Any person, firm, association, or corporation maintaining a business location or branch office within the Town for the privilege of engaging in or managing a business, profession, or occupation, within the Town. The Town's zoning use regulations specify what businesses are permitted to operate in the Town.

    Any person who utilizes a residential unit to conduct a home business, profession, or occupation. A license is required for each separate classification at the same business location.

What do I need in order to obtain an Occupational License?

    Contact the Town Clerk's office for general requirements and additional requirements for certain occupations. If you wish, you may click below for an Occupational License Application form.  You will need Acrobat Reader to download the application.

Some requirements include:

  •Address and Legal Description (Lot & Block) of the proposed business location.
  
  •Federal Employer Identification Number or Social Security Number (Required)
  
  •Proof of current Fictitious Name Registration (State Div. of Corporations, 850-487-6058 or www.dos.state.fl.us)
  
  •Professions regulated by the Department of Business and Professional Regulation must submit an active state license (904-487-2252)
  
  •Restaurant owners must submit a current State License (Department of Business and Professional Regulation, (305) 470-5680)

When does my license expire?

    Occupational Licenses are issued for one year beginning October 1 and expiring on September 30 of the following year. Licenses not renewed by October 1 of each year become delinquent and are subject to a delinquent penalty.

What is the penalty for operating without a current Occupational License?

    The penalty for operating without a current Occupational License starts at $250 and can escalate to imprisonment and closure of business.

Do I still need a Miami-Dade County Occupational License?

    Yes. A Town of Bay Harbor Islands Occupational License is required before Miami-Dade County will issue their Occupational License.
